•• В сознании каждого американца глубоко укоренено понятие due process. В Новом БАРСе вы найдете словосочетание due process of law и его перевод законный порядок. Перевод неудачный. Due process означает соблюдение предусмотренных законом процедур (процессуальных норм). Нет в словаре и другого широко распространенного выражения due diligence. Оно означает проверка благонадежности (финансового состояния) делового партнера или (юридической) чистоты сделки. Впрочем, эти переводы не полностью передают весь объем значений и подтекста, связанных с этим термином. Поэтому иногда дают обобщенный (и упрощенный) перевод необходимые формальности или («в осведомленных кругах») прибегают к кальке с английского в русской транскрипции. В переводных юридических текстах используется крайне неуклюжий и неточный перевод должная/ надлежащая заботливость. К сожалению, отказаться от этого варианта в юридических переводах, видимо, уже невозможно, поскольку замена устоявшихся клише влечет за собой последствия.
